SMS Terms & Conditions 

NPCA Text Program Terms

These SMS Terms & Conditions: NPCA Text Program Terms (“Terms”) apply to your use of National Parks Conservation Association’s (collectively, “NPCA,” “we” or “us”), short message service, also referred to as SMS or text messaging. Your participation in any NPCA text message program (“Program”) constitutes your express consent to receive automated communications (e.g., SMS and MMS messages) from NPCA at the mobile number you provided, including text messages sent using an automatic telephone dialing system. By signing up for a Program, you agree to these Terms and Privacy Policy, which are incorporated herein by reference. If you do not agree to these Terms, you must immediately discontinue your use of each Program by following the opt-out instructions below. 

Program Description 

NPCA offers one-time, periodic, and recurring text message Programs. By enrolling in a Program, you consent to receive text messages sent by, or on behalf of, NPCA at the mobile number to which you have directed NPCA to transmit these messages. 

Programs offered by NPCA include recurring and nonrecurring text messages related to advocacy, corporate partnerships, park notes, membership renewals, invitations to donate, travel opportunities, events or other NPCA-related news that NPCA thinks will be of interest to you. 

Not all mobile devices or handsets may be supported and our messages may not be deliverable in all areas. 

Changes to Terms 

You agree that NPCA, at its sole discretion, may revise, modify, or amend these Terms at any time. Any such revision, modification, or amendment shall take effect when it is posted to NPCA’s website. You agree to review these Terms periodically to ensure that you are aware of any changes. Your continued consent to receive NPCA text messages will indicate your acceptance of those changes. If you do not accept the changes, your sole remedy is to withdraw consent by texting STOP to an NPCA text message.

Opting In 

By providing your phone number or otherwise signing up for a Program, you expressly consent to receive text messages which may be sent via an automated telephone dialing system. Consent to receiving these messages is not a condition of becoming a member, donating, or otherwise interacting with NPCA. Further, you represent that you are the account holder, subscriber and/or customary user for the mobile number you enroll into a Program. You are responsible for notifying NPCA immediately if you change your mobile number. You may notify NPCA of a number change by visiting our Contact Us page to contact us. 

Cost 

Standard text message and data rates may apply. These rates may be changed by your mobile carrier and payable by you to that carrier. NPCA does not impose a separate fee for sending text messages. 

Participating Carriers 

The content of these text messages may not be available and viewable on all carriers. Participating carriers include, without limitation, AT&T, Verizon Wireless, Sprint, and T-Mobile USA, Indigo Wireless, MetroPCS, Bluegrass Cellular, Illinois Valley Cellular, Viaero Wireless, Pine Belt, GCI Communications, Nex Tech Communications, Shelcomm, Duet Wireless, Inland Cellular, James Valley Cellular (JVC), Standing Rock Telecom, Cross Wireless, Northwest Missouri Cellular, Alaska Communications Systems (ACS, Thumb Cellular, Carolina West Wireless, Union Telephone, MTPCS Cellular One (Cellone Nation), Cordova, Copper Valley Telecom, ASTAC, Rural Independent Network Alliance (RINA), West Central Wireless, Chat Mobility, SouthernLINC, Panhandle Wireless, Cellcom, Truphone, Google Voice, United Wireless, bandwidth.com (includes Republic Wireless), Altice Mobile, Atlantic Tele-Network International (ATNI), Brightlink, Inteliquent, Aerialink, Blue Wireless, Chariton Valley Cellular, Digital Communications Consulting, TextMe, Pioneer Cellular, East Kentucky Network (Appalachian Wireless), Limitless Mobile, Cellular One of N.E. Arizona, Nemont US UMTS, Nemont CDMA, MTA Wireless/Matanuska Kenai, Pine Cellular, Triangle Wireless, Telnyx, Enflick, C Spire Wireless (aka Cellular South), Virgin Mobile, Boost Mobile, United States Cellular Corp. NPCA, or its third-party service providers, reserve the right to add or remove eligible mobile phone carriers from any program from time to time. 

Mobile carriers, NPCA, and NPCA’s service providers are not liable for delayed or undeliverable messages.  

Message Frequency 

The number of NPCA text messages you receive will vary depending on how many of the NPCA Programs you sign up to receive messages from. For each Program, message frequency will vary. NPCA reserves the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. NPCA may stop texting you at any time with or without notice, including, for example, before you have received any or all messages that you otherwise would have received, but these Terms still will apply.

Opting Out 

You may opt-out of a Program at any time. To opt-out, text STOP, from the enrolled mobile device in response to an NPCA text message.  A message confirming that you have opted-out of the applicable Program will be sent to your mobile number. You can also contact NPCA and provide the enrolled device phone number at our Contact Us page to unsubscribe. You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that do not consist of the STOP or other keyword commands noted above and agree that NPCA and its service providers will have no liability for failing to honor such requests. If you unsubscribe from one of our Programs, you may continue to receive text messages from NPCA through any other Programs you have joined until you separately unsubscribe from those Programs.

Dispute Resolution 

Arbitration 

At NPCA’s sole discretion, it may require you to submit any disputes arising from these Terms or any NPCA text message Program, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Washington, D.C.’s laws.

Waiver of Class Action 

YOU AND NPCA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and NPCA agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

TO THE EXTENT PERMISSIBLE BY LAW, ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR ANY NPCA TEXT MESSAGE PROGRSM MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

Governing Law; Jurisdiction 

All matters relating to any Program and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the District of Columbia without giving effect to any choice or conflict of law provision or rule (whether of the District of Columbia or any other jurisdiction).

Any legal suit, action, or proceeding arising out of, or related to, any Program and these Terms shall be instituted exclusively in the federal courts of the United States or the courts of Washington, D.C although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Notwithstanding any other terms in these Terms, you acknowledge and agree that any actual or threated breach by you of these Terms will cause NPCA irreparable injury for which monetary damages would not be an adequate remedy. Accordingly, NPCA shall be entitled to injunctive or other equitable relief in any court of competent jurisdiction, without the obligation to post any bond, to remedy or mitigate any such actual or threated breach. This provision will not limit, and instead is in addition to, any other remedies available to NPCA at law or in equity.
